In 1991, Congress passed the Telephone Consumer Protection Act (TCPA) in response to consumer concerns about the growing number of unsolicited telephone marketing calls to their homes and the increasing use of automated and prerecorded messages.

Under this law, it is unlawful "to use any telephone facsimile machine, computer, or other device to send an unsolicited advertisement" to any "equipment which has the capacity (A) to transcribe text or images (or both) from an electronic signal received over a regular telephone line onto paper." This law allows individuals to sue the sender of such faxes $500 per fax.

Additionally, several states have laws that restrict the use of fax for the unsolicited advertising of products and services.
